Early-Access Website Terms of Use

1. Who we are

The NK Dresses website at nkdresses.com (the "Website") is operated by Reon Naude trading as NK Dresses, based in South Africa. In these Terms, "NK Dresses", "we", "us" and "our" refer to that operator.

NK Dresses is not currently a registered company. It is operated by an individual trading under the name NK Dresses. You can reach us at nkdresses26@gmail.com.

2. Acceptance of these Terms

These Terms apply to your use of the NK Dresses Website and to your participation in the early-access waitlist. By submitting an early-access waitlist application or using any Website functionality that expressly requires acceptance of these Terms, you agree to be bound by them.

You are free to browse the Website without joining the waitlist and without accepting these Terms.

If you do not agree with these Terms, please do not submit a waitlist application.

3. Pre-launch status

The Website is a pre-launch, informational website. The NK Dresses marketplace is still being built and is not available to use.

At this stage the Website does not allow you to:

rent, hire, book or reserve any dress
list a dress for rent
make or receive any payment
pay or receive a deposit
create a marketplace user account
enter into any rental agreement with us or with any other person

Any dresses, prices, availability, dates, sizes or screens shown on the Website are illustrative presentations of what we are building. They are not live listings, are not available to rent, and do not constitute an offer.

4. The early-access waitlist

The waitlist lets you register interest in NK Dresses so that we can contact you about launch and early access. Joining is entirely voluntary and free.

Joining the waitlist:

does not create an account
does not reserve a dress, a date or a place in any queue
does not guarantee that you will be offered early access
does not oblige you to use NK Dresses when it launches
does not oblige us to provide any service to you

You must provide accurate information, and you may only submit a mobile number that belongs to you or that you are authorised to provide.

We may remove any waitlist entry at our discretion, including entries that appear to be duplicated, automated or submitted without the number holder's authority.

6. No guaranteed launch or features

We have not committed to a launch date, and we do not promise that NK Dresses will launch, that any particular feature described on the Website will exist, or that it will be available in any particular area.

Everything described on the Website as planned or being built may change, be delayed, or be abandoned. Descriptions of how renting or listing is intended to work are statements of current intention, not promises.

7. Acceptable use

You agree not to:

submit false, misleading or fraudulent information
submit a mobile number you are not entitled to provide
use automated means to submit waitlist applications
attempt to gain unauthorised access to the Website, its systems or its data
interfere with, disrupt or place an unreasonable load on the Website
probe, scan or test the vulnerability of the Website without our written permission
copy, scrape or systematically extract content from the Website
use the Website for any unlawful purpose

8. Security and rate limiting

We apply technical measures to protect the Website from abuse, including limits on how often the waitlist form may be submitted from the same network or for the same mobile number. These measures may prevent or delay a legitimate submission.

We take reasonable steps to safeguard the Website and the information you give us, but no website or transmission over the internet can be guaranteed to be completely secure.

9. Intellectual property

The NK Dresses name, logo, text, layout, design and photography on the Website are owned by us or used with permission, and are protected by intellectual property law.

You may view and share the Website. You may not reproduce, distribute, modify or use our content commercially without our prior written permission.

10. Third-party providers

The Website relies on third-party providers for hosting, infrastructure and database services, and we use WhatsApp to contact people who have consented. Those providers operate under their own terms and privacy practices.

We are not responsible for the acts or omissions of third parties, or for the content of any third-party service.

11. Website availability

We provide the Website on an as-available basis. We may change, suspend, restrict or withdraw all or part of it at any time, without notice, including while we continue building the marketplace.

We do not promise that the Website will be uninterrupted or error-free.

12. Warranties

To the fullest extent permitted by law, and subject to the Consumer Protection Act 68 of 2008 where it applies to you, the Website and its content are provided without warranties of any kind, whether express or implied.

Nothing in these Terms limits or excludes any right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot lawfully be limited or excluded.

13. Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss arising from your use of, or inability to use, the Website or the waitlist.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under the Consumer Protection Act 68 of 2008 where it applies.

14. No financial transactions

The Website does not process payments. We do not ask for, and you must not send us, card details, banking details or any payment through the Website.

We will never ask you for payment to join or remain on the early-access waitlist. If you receive a message claiming otherwise, please treat it as suspicious and contact us.

15. Privacy

Our Early-Access Privacy Notice explains what personal information we collect, why, and what rights you have under the Protection of Personal Information Act 4 of 2013. Please read it before joining the waitlist.

16. Electronic communications

You agree that we may communicate with you electronically, and that electronic communications satisfy any legal requirement that a communication be in writing, as contemplated by the Electronic Communications and Transactions Act 25 of 2002.

Information required to be made available under section 43 of that Act is set out in these Terms and in our Privacy Notice.

17. Age and legal capacity

The Website is intended for people who have the legal capacity to agree to these Terms. If you are under 18, please only join the waitlist with the consent of a parent or guardian.

If you believe a child has joined the waitlist without appropriate consent, please contact us at nkdresses26@gmail.com and we will remove the entry.

18. Questions and complaints

Please send any question or complaint about the Website or the waitlist to nkdresses26@gmail.com. We will do our best to resolve it directly with you.

19. Governing law

These Terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.

20. Changes to these Terms

We may update these Terms as the Website develops. The version number and effective date at the top of this page will change when we do.

The version in force when you submitted a waitlist application is the version that applied to that submission.

21. Waiver and severability

If we do not enforce a right under these Terms, that is not a waiver of it.

If any provision of these Terms is found to be unenforceable, the rest of the Terms continue to apply.

22. Future marketplace terms

These Terms cover the pre-launch website and the early-access waitlist only. They do not govern rentals, bookings, payments, deposits, owner payouts, damage, late returns, disputes or full user accounts.

Separate marketplace terms and privacy provisions will be published and must be accepted before any of those services become available.
